Substitutions or Exemptions

Part III of the Accord Acts
Pursuant to section 151 of the Atlantic Accord Implementation Acts, the Chief Safety Officer (CSO) and/or the Chief Conservation Officer (CCO) may, on application, permit the use of equipment, methods, measures or standards in lieu of any required by regulations, where those Officers are satisfied that the use of that other equipment and those other methods, measures or standards would provide a level of safety, protection of the environment and conservation equivalent to that provided by compliance with regulations. They may also grant an exemption from any regulatory requirement in respect of equipment, methods, measures or standards, where those Officers are satisfied with the level of safety, protection of the environment and conservation that will be achieved without compliance with that requirement. Pursuant to this section, the application must include information with respect to the consequences to safety, protection of the environment and conservation that might reasonably be anticipated if the permission is granted and be accompanied by technical information sufficient to enable the CSO and/or CCO to make a decision on the application. To document and process such requests from industry, along with requests to clarify the application of specific regulations in specific cases, the Board has developed a “regulatory query process” that is administered by the Operations Department.

Part III.1 of the Accord Acts – Occupational Health and Safety
Pursuant to sections 205.069 and 205.07 of the Atlantic Accord Implementation Acts, the CSO may, on application, permit the use at a workplace or on a passenger craft, for a specified time and subject to specified conditions, of specified equipment, methods, measures, standards or other things, in lieu of any required by regulations made under this Part, if the CSO is satisfied that protection of the health and safety of employees at the workplace or on the passenger craft would not be diminished and the granting of the permission is not otherwise prohibited by regulation. Pursuant to these sections, the application must be in a form acceptable to the CSO, include information with respect to the consequences to health and safety that might reasonably be anticipated if the permission is granted and be accompanied by technical information sufficient to enable the CSO to make a decision on the application. With regards to a passenger craft, the application must also be accompanied by documentation issued by the Minister of Transport indicating that if the permission is granted, it would not contravene any Act or law that applies to the operation of a passenger craft. Applicants should note that while substitutions may be granted, the CSO does not have the authority to grant exemptions from regulations promulgated under this part of the Atlantic Accord Implementation Acts. Any application to the CSO under this part of the Atlantic Accord Implementation Acts will normally be made available to the public for a period of 30 days under the Public Submissions tab.

Regulatory Query Process
If an Operator or installation owner requires clarification on, equivalency for, or exemption from, a regulatory requirement, the applicant must submit a Regulatory Query Form outlining its proposal. For regulations related to the Certificate of Fitness, the proposal must be submitted to the Certifying Authority for their concurrence with the proposal. In addition, for Canadian flagged installations, where a similar requirement is in the Canada Shipping Act and associated regulations, the proposal must also be submitted to Transport Canada Marine Safety for review. The C-NLOPB may also seek advice from Transport Canada Marine Safety on proposals related to marine matters on foreign flagged marine installations or structures.

Following Certifying Authority and/or Transport Canada concurrence with the proposal where required, C-NLOPB staff will review the proposal. If C-NLOPB staff are satisfied that the applicant’s proposal provides for an equivalent level of safety, they will make a recommendation to the CSO and/or the CCO regarding the approval of the proposal.

Decisions are effective from the date of issuance until the earlier of:
a) the date a Regulation referenced is repealed or the date a particular subsection that is the object of a substitution or exemption being granted is amended or replaced, or

b) the date on which the CSO and /or CCO (as applicable) revokes a Decision as a result of i) any enforcement action by the Board related to the Decision or ii) new information or analysis coming to light challenging the assessment upon which the Decision was based, including but not limited to any changes to commitments made by the Applicant in its application.

 

All applications received in relation to Part III.1 of the Accord Act – Occupational Health and Safety and regulations under that Part are listed below. There is no obligation to publically post regulatory query applications received in relation to any of the other regulations.

The public is invited to provide comments in relation to an application by submitting them to information@cnlopb.ca. Please include the reference number in all submissions. Any submissions received will be forwarded to the applicant without the name and contact information of the submitter. The applicant will be requested to provide a written response to the CSO. The submissions and applicant’s response will form part of the CSO’s deliberations of the application.

Part III.I Regulatory Substitutions or Exemptions Applications currently under Public Review
As per Part III.1 of the Accord Acts – Occupational Health and Safety (OH&S), any application to the Chief Safety Officer (CSO) for a substitution or exemption in lieu of any required OH&S regulation is normally available to the public for a period of 30 days, unless a shorter timeframe is acknowledged by the Workplace Committee and CSO.As we continue to respond to the current global concern of COVID-19, we have determined that it may be appropriate to shorten the public review period, in consultation with offshore operator workplace committees, for particular submissions.

Governments are further extending the expiry date of the transitional regulations that came into force on December 31, 2014 associated with Part III.1 of the Canada – Newfoundland and Labrador Atlantic Accord Implementation Act (AAIA). Accordingly, the Chief Safety Officer advises that the Decision Report for any applicable Regulatory Query that was previously approved and remained in effect on December 31, 2020 is changed to read as follows:

“This exemption or substitution will remain effective until the Canada–Newfoundland and Labrador Marine Installations and Structures Occupational Health and Safety Transitional Regulations are repealed or any representations made in the application for exemption or substitution have changed, whichever is earlier.”

Operators have been advised that it is not necessary to resubmit a new application for any of those Regulatory Queries and that related correspondence has been placed on the associated files.
